Terms and Conditions

These Terms and Conditions ("Agreement") govern the use of services provided by Memories Matter ("Company") for photography and videography. By engaging our services, you ("Client") agree to abide by the terms and conditions stated herein.

1. Services Provided

a. Memories Matter specializes in providing professional photography and videography services.

b. All services are subject to availability and may be limited based on the Company's schedule.

c. The Company reserves the right to refuse or discontinue services at its sole discretion.

2. Eligibility

a. Memories Matter provides services exclusively to individuals who meet one of the following criteria:

i. Are recipients of government assistance programs.

ii. Can provide documentation proving they belong to a low-income household.

b. The Company may request proof of eligibility, such as official documents or income verification, to determine the Client's eligibility for services.

3. Bookings and Payments

a. Clients must contact Memories Matter to inquire about availability and book a photography or videography session.

b. All prices and payment terms will be discussed and agreed upon prior to the session.

c. Payments must be made in full before or on the day of the scheduled session, unless alternative arrangements have been agreed upon in writing.

d. The Company accepts various forms of payment, including cash, credit cards, or other agreed-upon methods.

4. Cancellations and Rescheduling

a. In the event that a Client needs to cancel or reschedule a session, at least 48 hours' notice is required.

b. If the Client fails to provide the required notice, a cancellation fee may apply, as determined by the Company.

5. Ownership and Usage Rights

a. All photographs and videos taken by Memories Matter remain the property of the Company.

b. Clients are granted personal usage rights to the photographs and videos for non-commercial purposes.

c. Clients may not sell, reproduce, or use the photographs and videos for commercial purposes without obtaining written permission from the Company.

6. Liability and Indemnity

a. Memories Matter will exercise reasonable care and skill in providing its services.

b. The Company shall not be held liable for any loss, damage, or injury incurred during the session, unless caused by gross negligence or willful misconduct on the part of the Company.

c. The Client agrees to indemnify and hold the Company harmless from any claims, damages, or liabilities arising from the use of the photographs and videos.

7. Confidentiality

a. Memories Matter respects the privacy of its Clients and will treat all personal information and images with strict confidentiality.

b. The Company will not disclose or share any personal or sensitive information without the Client's explicit consent, except where required by law.

8. Amendments

a. Memories Matter reserves the right to modify or amend these Terms and Conditions at any time.

b. Clients will be notified of any changes to the Terms and Conditions via the Company's website or other means deemed appropriate by the Company.

9. Governing Law and Jurisdiction

a. This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction].

b. Any disputes arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].
